Manufacturing conditions
Production
The products ordered will be manufactured in accordance with the technical standards in force.
Due to manufacturing constraints, the quantity produced may vary by +/- 10%, up to a maximum of +/- 1000 products compared with the quantity ordered. Where a minimum quantity is required, this rule applies to additional variations only, i.e. + 20% and up to a maximum of 2000 products.
When packaging or printed matter is supplied: the quantity delivered will be less than the number of items supplied if this is equal to the number of products ordered. This difference results from waste during packaging operations.
Production times vary depending on the production period and the type of packaging chosen.
Matrices are kept for a minimum of 2 years. After this period, MPO reserves the right to destroy them. No matrix (father or mother) will be returned to the customer, as the galvanic material belongs to MPO.
Authorisations
By placing an order with MPO, the customer guarantees that all copyrights and ancillary copyrights for the content of the input media (master, data) sent to MPO have been properly licensed for reproduction and that proof of licensing and/or authorisation for trademark use will be provided on request. The client shall indemnify MPO against legal claims, including claims against third parties.
Submission of items
The elements required for production (master, DLT, graphic elements, etc.) must comply with good practice. They will be stored for a period of two years from the order date (or the date of the last reprint). After this period, the items will be destroyed. The items entrusted to us must not be originals, only copies. They will not be returned. Semi-finished items used in the manufacture of products will be stored for three months free of charge. After this period, a quotation for this service will be sent to you.
DTP
We do not intervene on the DTP files submitted to us. Files that do not comply with our specifications will be systematically returned. In certain special cases and at the express request of the customer, we can carry out DTP work on the basis of precise specifications. An estimate will then be issued based on an hourly rate of €100 excluding VAT.
Terms and conditions of sale
Prices
In accordance with the European agreements on trade in goods, VAT is not shown on our invoices if you are in possession of a valid VAT identification number and the products ordered are delivered to a member state of the European Union (excluding France). If you are not in possession of the aforementioned VAT ID number or the products ordered do not leave the country of origin France, the French VAT (current rate 20%) will be charged on the invoices to you.
In the event of a variation of more than 5% in the price of the raw materials that make up the majority of our products (in particular polycarbonate, paper, etc.), we reserve the right to revise these prices at any time. The new price will apply immediately to all new orders.
Our tariff also includes the minimum amount of royalties (3C, 6C and MPEG-LA) estimated to date on the basis of negotiations between manufacturers and licence holders.
This price list applies to standard products in quantities of between 500 and 100,000 units. For larger quantities or specific products, our sales team will be happy to help you with your project.
Order cancellation
Any modification or cancellation of an order by the client will only be taken into consideration on the twofold condition that it is notified in writing and that the products manufactured are not in the process of being manufactured. Any cancellation of an order meeting these two conditions shall entitle MPO to compensation, exclusive of tax, equal to 15% of the total amount of the order. In the event that orders have been placed with our suppliers specifically for this operation, the associated costs will be invoiced in full.
Billing and payment terms
Billing
Given manufacturing constraints, products delivered and invoiced may vary by +/- 10% in relation to the quantity ordered (up to a limit of +/- 1000 units), and by +/- 20% in the case of a minimum quantity imposed (up to a limit of +/- 2000 units). Invoicing is based on the quantities actually delivered. A supplement of €150 will be charged for any request for delivery of exact quantities, whatever the volume.
Regulations
For all first orders, a cash payment will be required. The terms of payment may subsequently be reviewed in consultation with our financial departments on the basis of the forecast volume of business and the financial information you provide when you open your account.
Terms of delivery / transfert of ownership
It is agreed that the goods invoiced to clients shall not become the property of the client until MPO has received the agreed price in full (law no. 80335 of 12.05.80).
Customers hereby assign to MPO the receivables arising from the resale and all related rights.
